Introduction

These Terms and Conditions regulate the sale of products through the website www.mochinho.pt.

The use of the website www.mochinho.com and the purchase of products on said website presupposes the knowledge, understanding and acceptance of these Terms and Conditions by the User, and it is expressly prohibited to purchase our products by minors or any abusive, fraudulent and bad faith use of this website. Understand by user, any individual who places an order through said website.

Unless otherwise stated, the contents of the website, text, graphics, photographs are reserved to the company, being prohibited their use, for commercial purposes or not.

Product Catalog (Online Store)

All information about the products marketed through the Mochinho website can be consulted on the website itself. If the product is unavailable or out of stock, it will be duly marked. If for some reason the user made a purchase of a product that is not available, he will be informed as soon as possible by email to choose to cancel the purchase or choose a different product.

We have the utmost concern in showing the colors of the products as close as possible to reality. However, due to existing variations such as user screen quality, there may be changes and we cannot guarantee that they are entirely faithful to reality.

We reserve the right to modify at any time without prior notice the information of products, product offer, prices, promotions and commercial conditions presented on this website.

Purchase Process

At Mochinho, you can make any purchase without the need for registration. Just select the products you want and fill in the necessary information to complete the process, warning that some of these fields are mandatory and are duly marked.

Before completing the purchase, you must confirm the desired items, total price (transport and VAT included) and shipping data. Providing an incorrect or incomplete delivery address may result in its return to Mochinho, resulting in additional costs for the Customer.

As the user is solely responsible for filling in these fields, he must take care to provide all correct data and keep all registration information confidential and non-transferable.

Any purchase on this website that violates legal and good faith conditions of use will be canceled without prior notice and without any compensation.

Prices

The prices of the products displayed on the Mochinho website are subject to VAT under the legal terms in force.

The prices of the products presented on this website are subject to change and Mochinho reserves the right to change them without any prior notice, with the prices displayed at the time of purchase being the prices applied to that purchase.

Payment Methods

The available payment options are MB Way and MB and for this Mochinho uses the Ifthenpay entity.

Shipping

The items whose purchase is finalized will be sent via CTT Expresso after good collection and will only be reserved for up to 48 hours without the respective payment. At the end of this period we are not responsible for the sale or eventual stock breakage of the same items.

Once the order is shipped, the user will receive a confirmation email with details regarding the payment method he selected.

The order will be delivered from Monday to Friday (business days) at the delivery address indicated in the purchase process and with the respective detailed invoice, within 2 to 3 business days for mainland Portugal, 8 business days for the Islands and 10 business days for Europe. In holiday periods there may be an extension of this period, since orders will be dispatched after this time or due to delays inherent to the distributor itself that are beyond our control.

Providing an incorrect or incomplete delivery address may result in its return to Mochinho, resulting in additional costs for the Customer, so we recommend that you always make sure that the delivery address indicated when registering the order is correct and complete. Once the order is processed, it is not possible to change the delivery address or the billing data you indicated.

Mochinho reserves the right not to accept any orders or cancel already confirmed orders that:
1 – Are no longer available;
2 – Payment is not confirmed;
3 – There is an error in the price quote;
4 – It is not possible to deliver to the address provided by the User.

Shipping and transportation fees will be calculated according to the shipping zone (mainland Portugal, Islands, Spain and the rest of Europe) plus VAT and for orders over 50 euros for mainland Portugal, shipping is free.

Mainland Portugal: 3.40 euros + VAT
Portugal (Islands): 15 euros + VAT
Spain: 6 euros + VAT
Rest of Europe: 17 euros + VAT

The user may withdraw from the purchase made within a maximum period of 14 days from the moment the order is received.

If you wish to do so, you must send an email to geral@mochinho.pt, where identification data such as name and surname, address, email, contact telephone number, order number and date and which items you wish to return must be included.

After this process, the User must send the products in his possession that he wishes to withdraw to:

The costs related to the return process are entirely borne by the user.

Mochinho will refund the corresponding amount by bank transfer and this will only be made from the moment we have received the returned products and an inspection has been carried out to assess their conditions:
a) The product(s) have not been used;
b) The product(s) maintain their original characteristics and intact labels/packaging;
c) The product(s) are complete. All material that accompanies orders must be returned.

If the returned items show signs of use, Mochinho reserves the right not to accept the return and to refuse to refund them.

Defective or damaged products

When the product is defective or damaged, it must be reported, if possible documented with photographs, to the email geral@mochinho.pt. Once the incident is confirmed, Mochinho will indicate how to collect or send the defective product at no cost to the User. When returned, it must not show any signs of use and with all packaging, plastics, labels and accessories. Mochinho will claim before the corresponding manufacturer or distributor in order to replace the item with another of identical characteristics. If it is not possible to replace the product, Mochinho will inform the User about this circumstance and proceed to refund the value of the product.

The order is considered accepted if, after receiving the order, it is not returned within 14 (fourteen) days.

Modification of Terms and Conditions

Mochinho reserves the right to change these Terms and Conditions at any time, with changes made and users notified by publishing the modified Terms and Conditions on the website www.mochinho.pt.

Applicable Law

These Terms and Conditions and all emerging disputes related to them, including their validity, use of the website or any purchase on it must be governed by Portuguese Law.
